These terms and conditions (“Terms of Service") govern the access to and use of the Services provided by Cascading AI, Inc ("Casca") as set forth in section 1. By accessing or using these Services, you agree to be bound by these Terms of Services and our Privacy Policy.
If you do not agree with any part of these Terms of Service, you may not access or use Casca's Services.
Casca provides an AI-powered loan origination platform (“Casca Platform”) as Software as a Service to various banks, financial institutions, credit unions, licensed lending entities, or other third-party providers of credit or loan products (“Lenders”) that offer, underwrite, originate, or fund loans or other financial products in accordance with applicable law within the United States. The Casca Platform comprises features that facilitate the collection, analysis, and transmission of loan application data and offers functionalities such as online applications, document collection, data analysis, credit assessment support, and workflow management.
Moreover, Casca operates as a technical service provider via its website a digital service (“Service”) that enables users (“you” or “User”) to submit information for the purpose of being matched with Lenders which are using the Casca Platform (“Casca Customers”) for their loan origination. This Service is intended to determine the qualification criteria for the potential Lenders.
Casca is not a Lender, does not make any credit decisions, and does not issue any loans or credit. All loan decisions and funding (if any)are made independently and solely by the Casca Customer acting as Lender, whose terms, conditions, and disclosures will apply to any resulting relationship with you.
Casca does not endorse or recommend any Casca Customer or its lending product. Casca does not guarantee that you will be matched with a Lender or that you will qualify for a lending product or loan offer.Content and tools provided as part of the Service are for informational purposes only and do not constitute legal, financial, or tax advice.
You must be at least 18 years old, legal resident of the United States and legally authorized to represent the applicant business in order to use the Services. By submitting information, you represent and warrant that all data is accurate, current, and complete and that you are meeting these requirements. All our Services apply currently only to business loans, no requests for consumer loans are processed or reviewed.
You acknowledge and agree that Casca uses artificial intelligence (“AI”)technologies and automated systems (“AI Services”) to process, analyze, and interpret data you provide, as well as to facilitate communications and deliver certain features of the Services. These AI Services may include, without limitation, automating responses, analyzing content, improving service quality, and enhancing user experience. However, Casca maintains “human-in-the-loop” best practices, ensuring any and all communication effected by AI is reviewed by human users. This includes but is not limited to credit decisioning, phone, email and SMS communications, and other forms of engagement.
By using the Services, you consent to the use of AI Services for these purposes, subject to our Privacy Policy and applicable law.
To access the features of the Casca Platform required for the provision of theServices, you may be required to create an account and provide registration details. You agree to provide true, accurate, current, and complete information and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You are obligated to notify Casca immediately of unauthorized use or suspected breach of security. Casca may suspend or terminate your account at its discretion.
You agree to use the Services solely for lawful purposes and in accordance with these Terms of Service. You may not:
Casca collects and processes information strictly in accordance with its Privacy Policy. By using the Services, you consent to the collection and use of your personal information as described therein.
When you submit a request for loan-related services, we may share your information with one or more independent potential Lender in accordance with our Privacy Policy. Any offers, quotes, approvals, or other communications from a potential Lender and not by Casca. You are responsible for reviewing and understanding the terms, rates, fees, and disclosures provided by any the respective Lender before entering into a transaction.

These terms are legally binding and must be accepted before submitting an application.
All content on the Casca Platform — including but not limited to software, graphics, logos, designs, and text — is the property of Casca or its licensors and is protected under intellectual property laws. You may not copy, reproduce, or use any part of the platform without express written consent.
Our platform may contain links to third-party websites orintegrate services from external providers. We are not responsible for the content or practices of these third parties.
Casca provides the Casca Platform and the Services "as is" without warranties of any kind. Casca expressly disclaims all warranties, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Casca does not guarantee loan approval, funding, or the accuracy of any third-party data provided through the Services.
To the fullest extent permitted by law, Casca shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services, including delays in processing, system outages, or errors in data handling.
You agree to indemnify and hold harmless Casca, its officers, employees, and agents from any claims, liabilities damages, or losses and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Services or the Casca Platform.
This Agreement shall be governed by the laws of the State of California. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in San Francisco County, California.
Casca reserves the right to modify these Terms at any time.We will notify users of material changes by updating the effective date and posting the new version on our website. Continued use of the Casca Platform constitutes acceptance of the revised Terms.
